TUNL PAIA Manual

What is a PAIA Manual: TUNL is based in South Africa, where all private bodies are required to maintain a manual in terms of the Promotion of Access to Information Act 2 of 2000 (as amended) (PAIA). Welcome to the TUNL PAIA Manual, which has been prepared in compliance with PAIA, as read with the Protection of Personal Information Act 4 of 2013 (as amended) (POPIA).
  2. Introduction: TUNL is a logistics and export platform which enables South African businesses to export their products to new markets. Our website should have all the information that you need, but please do reach out to us if you have questions.

  1. Records that we make automatically available: Some records are automatically available to you without you needing to request access to them (e.g. information available on our website, and available through BiZPortal). If you are a Customer on our platform, you will be able to request access to your own information through the platform itself, with no fees being payable.
  2. Records we hold to comply with Legislation: We hold electronic/digital records that all companies in South Africa are required by law to hold. These records include (but may not be limited to) those held and maintained in accordance with the following:

  1. Records we hold to operate as a business: We hold the following categories of information in electronic or physical format, which we do not make automatically available. You may request access to them, but grounds for refusal as set out in PAIA or other applicable legislation may be applicable to your request. These are records that most organizations have.

  1. Processing of Personal Information: We process personal information in accordance with our Privacy Policy. This Privacy Policy details the categories of personal information that we collect, how this is collected, and how and why this personal information is used.
  2. How you can request access: To request access to a record, please complete Form 2 at this link, and submit the completed form, together with the relevant request fee referenced below, to our Information Officer using the contact details listed above. If you do not use the standard form, we may reject the request due to lack of procedural compliance, refuse it if you do not provide sufficient information, or delay in our response. If you are unable to complete the form for any reason, please contact us. Please ensure that the completed form: 

      (i) has enough information to identify you, the requested records and the form of access required;

      (ii) specifies your contact details;

      (iii) describes the right that you seek to exercise or protect; 

      (iv) explains why you need the requested record to exercise or protect that right; and

      (v) provides proof of capacity if you are making the request on behalf of someone else. 

  1. Responses to Requests: We will evaluate and consider all requests we receive. If our Information Officer approves your request, we will decide how to provide access to you, unless you have asked for access in a specific form for a clear reason. Publication of this manual does not give rise to any rights to access information records, except in terms of PAIA, and there shall be no guarantee of a positive outcome to your request. Requests will be dealt with within 30 days from date of receipt unless you set out special grounds that satisfy the Information Officer that the request should be dealt with sooner. The period of 30 days may be extended by not more than 30 additional days, if the request is for a large quantity of information, or the information cannot be reasonably obtained within 30 days - in this event the Information Officer will notify you. 
  2. Grounds for Refusal: We are entitled to refuse access to certain records in terms of PAIA on any of the following grounds, subject to relevant exceptions in PAIA: 

      (i) protection of another’s right to privacy;

      (ii) protection of third party commercial information;

      (iii) protection of another’s confidential information; 

      (iv) protection of research information; 

      (v) protection of the safety of individuals and/or property; 

     (vi) protection of records which would be regarded as privileged in legal proceedings; 

     (vii) protection of trade secrets or information which (if disclosed) could likely cause harm to the financial or commercial interests;

     (viii) protection of information which, if disclosed, could put TUNL at a disadvantage in contractual or other negotiations or prejudice TUNL in commercial competition; 

     (ix) protection of intellectual property rights; or

     (x) frivolous or vexatious requests, or which involve an unreasonable diversion of resources.

  1. Remedies should a Request be refused: If we deny your request for access, you may apply to a court  in accordance with section 78 of PAIA, or complain to the Information Regulator (details set out above), for the necessary relief within 180 calendar days of us notifying you of our decision. 
  2. Fees: You will be required to pay the prescribed Request and Access Fees in respect of all requests for access to information.
